Please read these Terms and Conditions (“Terms”) carefully before using the customer hosting and domain management control panel at https://controlpanel.davehigham.com (“Control Panel”) operated by Dave Higham (“I”, “me” or “my”).

Your access to and use of the Control Panel is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Control Panel, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Control Panel.

1. Account Registration

To use the Control Panel, you must register for an account by providing the required information. You agree to keep your account information accurate, complete, and up-to-date. You are responsible for all activity that occurs under your account, and you must maintain the confidentiality of your account password.

2. Hosting and Domain Services

My hosting and domain services are provided through my reseller account with 20i.com. By using the Control Panel, you agree to comply with any applicable terms, conditions, and policies of 20i.com.

3. Payments and Refunds

By using the Control Panel, you agree to pay the fees for the services provided. Payments are due upon receipt of the invoice, and overdue payments may result in suspension or termination of your services. Refunds are provided at my sole discretion and may be subject to a processing fee.

4. Service Level Agreement

I strive to provide a high level of service and maintain the availability of the Control Panel. However, I cannot guarantee uninterrupted access or error-free performance. In case of any service interruption, I will make reasonable efforts to restore the services as soon as possible.

5. Acceptable Use Policy

You are responsible for your use of the Control Panel and the content hosted on your account. You agree not to engage in any activity that is illegal, harmful, or violates the rights of others, including but not limited to:

• Transmitting or storing harmful or malicious code
• Sending unsolicited messages or spam
• Infringing on the intellectual property rights of others
• Hosting or sharing content that is defamatory, harassing, or promotes hate speech, violence, or discrimination

I reserve the right to suspend or terminate your account if you violate the Acceptable Use Policy.

6. Data Protection and Privacy

Your privacy is important to me. Please review my Privacy Policy for information on how I collect, use, and disclose your personal information when you use the Control Panel.

7. Limitation of Liability

In no event shall I be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use the Control Panel
• Any conduct or content of any third party on the Control Panel
• Any content obtained from the Control Panel
• Unauthorised access, use, or alteration of your transmissions or content

8. Changes to the Terms and Conditions

I may update these Terms and Conditions from time to time. I will notify you of any changes by posting the new Terms and Conditions on this page. You are advised to review these Terms and Conditions periodically for any changes. Changes to these Terms and Conditions are effective when they are posted on this page.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
